These Terms of Service ("Terms") are a binding agreement between you and FanClub+ ("FanClub+", "we", "us") governing your use of our adults-only AI companion platform (the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Usage Policy. If you do not agree, do not use the Service.
FanClub+ provides AI-generated companion personas you can chat with by text and voice, and from whom you can request or unlock images, using a virtual token system. All companions are software, not real people.
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and legally able to enter into contracts. The Service contains adult, suggestive material and is intended only for adults. By using it you represent and warrant that you meet these requirements and that adult content is lawful where you live. You are responsible for ensuring your use complies with all laws applicable to you.
Your use of the Service is governed by our Usage Policy, which forms part of these Terms. In summary, you must not use the Service for anything illegal, attempt to generate or solicit content involving minors or non-consent, harass others, attempt to reverse engineer or extract data, or try to manipulate the AI into producing prohibited content. Breaching the Usage Policy may result in immediate suspension or permanent closure of your account without refund.
The companions are AI-generated personas. They are not real people, have no feelings or independent existence, and cannot meet you, call you, or do anything outside the Service. To make conversations feel natural they may remember details you share. Replies are automatically generated and may be inaccurate, inconsistent, or unsuitable; they are provided for entertainment only and must not be relied upon as advice (including medical, legal, financial, or psychological advice). Any sense of relationship is a feature of the experience, not a real human relationship.
The Service is an adult platform for users 18+. Conversations and images may be flirtatious, suggestive, or adult in nature, for entertainment purposes. The following are strictly prohibited and will result in immediate account closure without refund and may be reported to authorities: any content sexualising minors or anyone appearing under 18; content depicting non-consent, sexual violence, bestiality, or other illegal acts; and any unlawful use. You retain ownership of the messages and information you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, process, and use your User Content as needed to operate, secure, and improve the Service (including sending it to AI providers to generate replies). You are responsible for your User Content and confirm you have the right to submit it.
The Service, including the companions, images, software, text, and branding, is owned by FanClub+ or its licensors and protected by intellectual property laws. You may not copy, scrape, redistribute, sell, or create derivative works from any part of the Service without our written permission. Images and content are licensed to you for personal, non-commercial use within the Service only.
We may suspend or terminate your access at any time, with or without notice, if we believe you have breached these Terms or the Usage Policy, to protect the Service or other users, or as required by law. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including payment, disclaimers, limitation of liability, and indemnity) will survive.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or appropriate. To the maximum extent permitted by law, we disclaim all such warranties.
To the maximum extent permitted by law, FanClub+ and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 3 months before the event giving rise to the claim, or (b) GBP £50. Nothing in these Terms excludes liability that cannot be excluded by law.
You agree to indemnify and hold harmless FanClub+ from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your breach of these Terms or applicable law.
These Terms are governed by the laws of England and Wales (unless mandatory local law applies to you). The courts of England and Wales will have jurisdiction, except where your local consumer law gives you the right to bring proceedings in your own country. You agree to first contact us to try to resolve any dispute informally before commencing formal proceedings.
We may update these Terms from time to time. We will post the updated version and, for significant changes, notify you by email or in-app. Continued use after an update means you accept the revised Terms.
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale. These Terms, together with the Privacy Policy and Usage Policy, are the entire agreement between you and us regarding the Service. We are not liable for failures caused by events beyond our reasonable control.
